ART. 1 Preamble
GOBELETCUP reserves the right to adapt or modify these terms and conditions at any time without prior notice. By validating the budget and the order, the customer declares to have read and accepted without reservation these terms and conditions.
ART. 2 Orders made by professionals
GOBELETCUP confirms an order after fulfillment of the budget, duly dated, signed and stamped, referring to all the elements of the order. Once the budget has been validated and the payment has been made, the production process will begin, so it is not possible to cancel the order.
ART. 3 Payment made by professionals
All products ordered are paid in full at the time of ordering.
Forms of payment available: check, money, bank transfer and credit card. In payments by check, for orders over 3,000 € (VAT included), production will start only after the check is cashed (except in cases where the order has already been negotiated and validated).
ART. 4 Delivery / Customer order picking
Delivery costs: GOBELETCUP makes deliveries worldwide. The delivery costs will be indicated in the order form (request for quotation) addressed to GOBELETCUP.
The customer can choose to use his own carrier. In this case, Gobeletcup can not be held liable for any damage or problem encountered during the transport.
ART. 5 Delivery time
After payment by the customer, the order is sent within a minimum of 48 hours to 72 hours, depending on the availability of transportation. For orders with customizations, the deadlines are higher.
The carrier does not deliver the parcel within the building of the address indicated by the customer. The Gobeletcup is not responsible for the delay of delivery for reasons unrelated to its will and unforeseen. If the indicated delivery time is not respected, and it is exceeded in 8 weeks, the customer can cancel his order by means of a letter with acknowledgment of receipt to the following address:
If the order has already been delivered on the date of receipt of the letter, the cancellation will not be valid. If the order is not sent or delivered, GOBELETCUP has the obligation to reimburse the customer within 30 days.
In order for the order to be processed, the customer has the duty to transmit all the requested information required for delivery, namely the telephone number to which he wishes to be contacted to arrange a possible meeting. When validating the order, the customer undertakes to order the order in the place indicated by him. When requested by the carrier, the customer has to justify his identity in order to receive his order.
During delivery, the customer has the duty to verify the content of the order and the conformity of the delivery note in relation to his order. If the products are in compliance, the customer must sign the order form.
Signing means that the customer acknowledges receiving the order and claims to be satisfied with its content. You undertake not to make a complaint against GOBELETCUP, which can not be later held liable for any anomaly or nonconformity.
If the customer refuses to sign the order form, the carrier is not authorized to deliver it. The cost of a new delivery will be borne by the customer.
Art. 6 Right of cancellation
In the case of distance, mail or Internet sales, the consumer has the right to change his mind and exercise his right to cancel the order within 14 days (established by the Hamon law, valid for contracts entered into after 14 June 2014), from the receipt of the order, without having to justify its intentions or pay fines – except, if applicable, the shipping costs associated with the return of the parcel.
In case of cancellation, the customer must return the order in good condition, complete, unused and properly protected in the original packaging and accompanied by a copy of the purchase receipt.
These provisions do not apply to custom products (with the customer’s logo or other print), unless defective.
ART. 7 Return / Exchange / Refund Conditions:
The request for exchange or refund must be made within 14 days from the date of delivery of the order. The return of products will result in the exchange or refund equal to the price of the parcel returned, leaving the shipping costs to the customer’s charge (unless the responsibility of GOBELETCUP is verified). If it is a defective product, GOBELETCUP assumes the costs of return.
Your right of withdrawal will only apply to products that are returned under the same conditions as those in which you received them. No refund will be granted if the product has been used after being opened, if it is not in the same condition as at the time of delivery or if it has been damaged.
ART. 8 Problems with delivery / Order picking:
The customer has the right to refuse to sign the delivery note and to reject all or part of the order if it is defective or incomplete. If the client signs the delivery note, he can not later claim from GOBELETCUP the right to refuse, return – even partial – or refund. If delivery does not comply with the request made by the customer in terms of quality and quantity, the customer must inform GOBELETCUP within 48 hours, indicating the reference of the order in question, contacting our consultants on +33(0) 1 76 21 19 98 or by mail.
ART. 9 Penalty clause in case of non-payment
Penalty Clause: application of 21% of VAT after infringement. By signing the quote, the customer acknowledges and accepts the terms of this agreement. For any dispute, the Créteil Court has exclusive jurisdiction.
ART. 11 Warranty conditions and Customer Service
The invoice issued during the processing of the order can be used as proof of guarantee. All products sold are subject to strict quality control to ensure their normal use.
GOBELETCUP® guarantees the conformity of the delivered products with the current technical regulations
Quality: The customer can not have any guarantee right if it is verified that the conditions of use of the products were not respected. Products used are not returned or exchanged.
ART. 12 : Custom cups
Screen printing / four-colour printing personalisation are industrial printing techniques for which GOBELETCUP is obliged to impose a tolerance percentage on the quantity and quality delivered (+ or – 5%) in relation to the initial order.
